Final Proposed Zoning Code Edits

As we near our public hearings and consideration of adoption, the project team made a few final edits to the zoning code. You will note that we have on this page a June 13 version and a Final Version for Adoption on the main project page; we've been working to make some last clarifications and corrections before the Council's vote.

You can review the redlined version between the Public Comment Draft and the Final Proposal here, or you can see the changes summarized below:

  1. Allow up to 1 unregistered or uninsured motor vehicle per lot as per current policy
  2. Exclude massage parlors, autobody/autobody part sales and repairs, mobile automobile mechanical and autobody repair, and physician’s office from home occupation by-right
  3. Update the dimensional standards image and definition of height to be consistent
  4. Add a clause requiring parking stalls to be at least five feet from the portion of structure used as a dwelling located on an abutting property.
  5. Add Prohibitions: Off-street non-accessory parking facilities are not permitted.
  6. Add a figure showing how fence height requirements are applied
  7. Improve the specificity of the Temporary structures and trailers definition and reference the new definition in the text
  8. Affordable housing regulations apply to two or more units, not a single unit, to be consistent with current policy.
  9. Planning Board to determine whether or not a street meets the requirements rather than the City Council
  10. Boarders and roommates removed from the definition of home occupation
  11. Truck parking accessory use changed from 15,000 lbs. to 14,001 lbs. to be consistent with home occupation parking limitations
  12. Miscellaneous typos corrected and discrepancies resolved, including a correction on the dimensional table where two columns had been swapped and clarifying that home occupations can accommodate up to two customers or clients at a time.
